PAYMENTS FOR CUSTOM DESIGN

Payment for custom design is split in to 2 parts, 50% due upon delivering the first draft, and the other half is due upon approving the final draft.

OWNERSHIP OF CUSTOM WORK

All imagery, clip art and fonts used in our products are royalty-free and are the integral part of our products. One Time Usage License.

TEMPLATES TERMS

1. IMPORTANT INFORMATION

You should carefully read the following Terms and Conditions. Your purchase or use of our products implies that you have read and accepted these Terms and Conditions.

2. LICENSE

Our website grants you three possible types of license to use the web templates and other products (the “products”) sold through our website by independent content providers in accordance with these Terms and Conditions (the “license”) issued by our company, as follows: a) ONE TIME USAGE LICENSE You may be granted a One Time Usage License in case of purchasing a website template at a Non-Unique Price. It enables you to use each individual product on a single website only, belonging to either you or your client. You have to purchase the same template again if you want to use the same design in connection with another or other projects; b) BUYOUT PURCHASE LICENSE You may be granted a Buyout Purchase License in case of purchasing a website template at a Buyout Purchase Price. This type of license guarantees that you are the last person to buy this template. After the buyout purchase occurs, the template is permanently removed from our sales directory and is never available to other customers again. You can not redistribute or resell templates after Buyout Purchase Price.

3. IMAGERY, CLIP ARTS AND FONTS

All imagery, clip art and fonts used in our products are royalty-free and are the integral part of our products. One Time Usage License and Developers License give you the right to use images, clip art and fonts only as a part of the website you build using your template. You can use imagery, clip art and fonts to develop one project only. Any kind of separate usage or distribution is strictly prohibited. All images and illustrations used in templates come in a single layer, as is.

4. MODIFICATIONS

If you have not received the Buyout License, you shall not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium. You also shall not offer them for redistribution or resale of any kind without prior written consent from our company.

5. UNAUTHORIZED USE

We do not install any of our products which require installation (osCommerce templates, Zen Cart templates, etc.) Installation is a paid service which is not included in the package price.

6. ASSIGNABILITY

You shall not sub-license, assign, or transfer the any mentioned above to any entity without prior written consent from our company.. Our company reserves the right to change or modify these terms with no prior notice.

7. OUR REFUND POLICY

Since our website is offering non-tangible, irrevocable goods we do not issue refunds after the product is shipped, which you acknowledge prior to purchasing any product at our site. Please make sure that you’ve carefully read ‘sources available’ section. We only make exceptions with this rule when the product appears to be not-as-described on a case by case basis at our sole discretion.

8. OWNERSHIP

You do not claim intellectual property right or exclusive ownership to any of our products, modified or unmodified. All products are property of independent content providers. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our company or its agents be liable for any damages including, but not limited to, direct, indirect, special, punitive, incidental or consequential, or other losses arising out of the use of or inability to use our products.

9. ANTIFRAUD CHECK

Customer purchase can be suspended for manual antifraud check for 10-20 minutes as well as it can be suspended for a longer term for more serious investigations. Antifraud check occurs because of growing number of fraud transactions from persons who are not actual cardholders of the credit cards used during purchase.

10. THIRD-PARTIES SERVICES

We may use third parties to provide certain services accessible through the website. Our website does not control these third parties or their services, and you agree that our company will not be liable to you in any way for your use of such services. These third parties may have their own terms of use and other policies. You agree to comply with such terms and policies as well as these. If any such terms or policies conflict with our terms, agreements or policies, you must comply with those of our website.

11. INFORMATION DISCLOSURE

You may not disclose any order information including, but not limited to, Order ID, download link, etc. Our company reserves the right to change or modify these terms with no prior notice.

12. DOWNLOADING FREE IMAGES

Free images on Pr On Site are bound to Creative Commons Deed CC0. To the extent possible under law. You are free to adapt and use the Images for commercial purposes without attributing the original author or source. Although absolutely not required, a link back to Pr On Site would be nice.

LIMITATIONS

• Images depicting identifiable persons may not be used for pornographic, unlawful or other immoral purposes, or in a way that can give a bad name to people, or to imply endorsement of products and services by those persons, brands, organizations, etc.
• Since raskhan.com does not require a written Model Release for each Image that has identifiable people on it, We cannot guarantee that You will be able to use the Image for any purpose You like. Also, if there is a model release for the Image, We do not represent or make warranties whatsoever as to the legality or validity of it.
• Furthermore, certain Images may be subject to additional copyrights, property rights, trademarks etc. and may require the consent of a third party or the license of these rights. Raskhan.com does not represent or make any warranties that it owns or licenses any of the mentioned, nor does it grant them.
• You are not allowed to mass download Images with an application, or reuse a big part of the Images for redistribution on a similar Website. Texts including image descriptions and tags are copyrighted.
• Raskhan.com can not be held responsible for any copyright violations, and cannot guarantee the legality of the Images stored in its system.

13. THIRD PARTY WEBSITE

We are governed by 3rd party website terms & conditions include but not limited to PayPal.ca, 1and1.ca, depositphotos.com, themeforest.net, and other websites that we used their service and their term and conditions apply to our services.
